By using CF Gears (a brand operated by ICONIUM DIGITAL SYSTEMS LLC), you agree to these terms. Please read them carefully.
You must be a business owner or authorized representative of a business to create an account. You are responsible for maintaining the security of your account and password.
The discounted "Charter Customer" rate of $19/month is a lifetime guarantee for our first 50 partners. This rate remains valid as long as the subscription remains active. If a Charter subscription is cancelled or expires due to non-payment, any subsequent re-enrollment will be at the standard market rate.
You agree not to use CF Gears for any illegal or unauthorized purpose, including the harassment of Customers or the sending of unsolicited "spam" messages.
You agree not to send any content that falls under the SHAFT (Sex, Hate, Alcohol, Firearms, Tobacco) categories, or any content related to high-risk financial services, debt collection, or gambling.
By using CF Gears, you (the "Client") agree to comply with the Telephone Consumer Protection Act (TCPA), the FCC's "One-to-One" Consent Rule (effective 2026), and all local telecommunications laws.
Client warrants that they have obtained express written consent from every recipient before sending an SMS through our platform. In accordance with carrier requirements:
Client may not use our service to send messages related to illegal substances, phishing, hate speech, or unsolicited marketing (spam). Use of the platform for "SHAFT" content (Sex, Hate, Alcohol, Firearms, Tobacco) or high-risk financial marketing is strictly prohibited.
CF Gears automatically appends "Reply STOP to cancel" to every message. Client agrees not to attempt to bypass these filters. To ensure compliance with the TCPA, Client shall not send messages outside of "Quiet Hours" (8:00 PM to 9:00 AM in the recipient's local time zone).
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Client must maintain records of each recipient's consent (including timestamp and source) for a minimum of four (4) years. ICONIUM DIGITAL SYSTEMS LLC reserves the right to audit these records or suspend service immediately if proof of consent cannot be provided upon request.
Client agrees to indemnify, defend, and hold harmless ICONIUM DIGITAL SYSTEMS LLC from any and all third-party claims, losses, or penalties (including carrier fines and TCPA litigation) arising from Client's failure to obtain proper consent or violation of these SMS Compliance terms.
CF Gears is a month-to-month service with no long-term contracts. You may cancel at any time via your dashboard. We do not offer pro-rated refunds for partial months of service already paid for.
CF Gears provides a platform for message delivery but does not guarantee 100% carrier uptime. We are not liable for any damages resulting from delayed or undelivered messages, or for any legal actions taken against you for violating SMS marketing laws.
